Terms of Service

These terms are an agreement between you and Seam Media, trading as TendCall ("we", "us"). By creating an account or using TendCall, you agree to them.
The service
TendCall provides an AI-powered receptionist that answers phone calls, SMS, social media messages, comments and reviews on behalf of your business, captures leads and shows everything in a dashboard. Features vary by plan as described on our pricing page.
Your account
You are responsible for keeping your sign-in details secure and for everything done under your account. The information you give us during setup must be accurate - your receptionist answers based on it.
Trials, billing and cancellation
- New accounts start with a 7-day free trial. A payment method is required at sign-up, and billing starts automatically when the trial ends unless you cancel first.
- Plans are billed in advance, monthly or annually, in Australian dollars via Stripe. Prices exclude GST unless stated otherwise.
- You can cancel anytime from Account, then Billing and subscription in your dashboard. Cancellation takes effect at the end of the current billing period, and we do not refund partial periods.
- If a payment fails and retries are unsuccessful, your subscription will be cancelled and the service switched off.
Plan limits and fair use
Plans include the call minutes described on the pricing page; additional minutes are billed at the advertised overage rate. All plans are subject to fair use - we may contact you about usage that materially exceeds what a plan is designed for.
Your obligations
- Use the service only for lawful purposes and only for a business you are authorised to represent.
- Calls answered by TendCall are recorded and transcribed. You are responsible for ensuring your use of call recording complies with the laws of your state or territory.
- Only connect social media and review accounts you own or are authorised to manage.
Important limitations
TendCall uses artificial intelligence. It is designed to be accurate and helpful, but like any AI it can occasionally make mistakes or mishear a caller. It is not a substitute for emergency services - callers with emergencies should always ring triple zero (000). We do not guarantee the service will be uninterrupted or error-free, and we rely on third-party providers (telephony, hosting, social platforms) that can have their own outages.
Liability
Nothing in these terms excludes rights you have under the Australian Consumer Law. To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect or consequential loss such as lost profits or missed business opportunities.
Intellectual property
We own the TendCall service and software. You own your business information and your data - we use it only to provide the service to you, as described in our Privacy Policy.
Suspension and termination
We may suspend or terminate the service for non-payment, unlawful use or misuse. You may stop using the service at any time by cancelling your subscription.
Changes
We may update these terms from time to time. The date at the top shows when they last changed. If a change materially reduces what you get, we will tell you before it takes effect.
Governing law
These terms are governed by the laws of New South Wales, Australia.
